Opis predmeta
- Glavni cilj ovog predmeta, koji je uveden kao Jean Monnet modul, je da studenti usvoje napredna znanja i razumijevanje materije materijalnog kaznenog prava EU i zaštite žrtava.Što se metodologije tiče, ovaj će predmet predstavljati forum za akademske debate te će razvijati kritičko promišljanje kod studenata i orijentiranost ka rješavanju problemskih zadataka. Studente će se ohrabrivati da postavljaju pitanja, komentiraju i debatiraju na satu.

To ensure minimum level of victims' rights in all Member States, the EU has adopted several EU legal instruments setting up common rules aimed at protecting and assisting victims of crime: horizontal instruments dealing with victims’ rights in general, more specific instruments on protection measures and financial compensation to victims of crime and on substantive law instruments regarding trafficking in human beings and child sexual exploitation.The EU Member States must implement the provisions of the Directive 2012/29/EU  into their national laws by 16 November 2015. DG Justice has issued a guidance document to assist Member States in this process. This document clarifies the provisions of the Directive, in order to help national authorities, practitioners and relevant service providers understanding what is required to make the victims' rights set out in the Directive a reality everywhere in the EU.The Directive is build on the key principle of the "role of the victim in the relevant criminal justice system". One should also discuss which role(s)  should come into question  when vicitms' role in the criminal procedure is defined - witness, private prosecutor, "civil party" etc.) 

In the class the current problem of the victim's right will be discussed (e.g. should legal persons be included as victims; what the right to access victims support service encompasses, the right to be heard, developing professional codes of conduct for the criminal justice authorities, individualized approach etc). Also, specific problems of Croatian society will be addressed (like securing justice and reparations to victims of war-time sexual violance (occured prior to the EU memebership); rights of victims and support - retributive or restorative justice (see art. 12. of the Directive)). Whole range of victims needs will be discussed that shpuld help them to recover: to be recognized and treated with respect and dignity, to be protected and supported, to hacve access to justice, and to obtain compensationa and restoration.   

 

Also, students should be able to dicuss their own national systems and be able to compare national provisions with the provisions of Directive establishing minimum standards on the rights, support and protection of victims of crime
