Description:

The introductory part: notion, meaning and sources of family law and registrarianship. Marriage law - notion and main characteristics, entering into marriage, form of marriage (civil and religious), preconditions for the existence of marriage, preconditions for the validity of marriage, termination of marriage - legal bases of termination, divorce, annulment and extramarital community. The legal relationships between parents and children: family status of a child, establishing of maternity and paternity, contesting the maternity and paternity, legal regulation of medically assisted procreation. Rights of child, parental care, realisation of parental care and measures for protection of personal and property interests of child. Adoption, preconditions for its realisation, procedure and the legal effects. Notion and meaning of guardianship, and also the main principles, types of guardianship, important questions regarding the legal status of guardian. Guardianship for minors, guardianship in special circumstances, deprivation of business capacity and the parental care for the adult child. Special rules of registrarianship, particularly those included in the State registers act and the Personal name act.

- explain all relevant facts related to the subject in practice to experts and lay persons

- describe the meaning of individual family law institutes

- group the most important elements connected with individual family law institutes

- explain the role of registrar in family law regulation

- summarise basic characteristics of the most important family law institutes

- use available domestic professional literature

- demonstrate knowledge and skills gained during the study in practice

- apply acquired knowledge about the rights and duties of the registrar in practice

Forms of testing knowledge

Oral examination

Oral examination generally represents more than mere reproduction of learned facts, so the student has to understand the subject matter well and to connect the facts. Additionally, students are expected to provide coherent and well founded explanation of their answers, and adequate argumentation of expressed points of view.

 

Grading criteria

Final grade

Oral examination is an interview with the student who has to understand the subject matter and connect the facts. Students are expected to have a sound knowledge about family law and registration and basic family law and registration postulates. Students are also expected to be able to solve simple difficulties in the application of norms in practice.
