Description:

Introduction: Diplomatic and Consular Law (history, sources); diplomatic relations. Diplomatic law: organs of international relations; diplomatic representatives. Diplomatic representatives of one state in another: Vienna Convention on Diplomatic Relations (1961); members of the diplomatic mission; head of the diplomatic mission; members of the diplomatic staff; other members of the diplomatic mission. Functions of the diplomatic mission. Diplomatic privileges and immunities: privileges and immunities of the diplomatic mission; privileges and immunities of diplomatic agents and other members of the diplomatic mission. Special missions: Convention on Special Missions (1969); concept of special missions; functions of special missions; privileges and immunities of special missions. The representation of states in international organizations: Vienna Convention on the Representation of States in Their Relations with International Organizations of a Universal Character (1975); concept and classification of international organizations; the representatives od states to international organizations; privileges and immunities. International officials. Consular law: concept of consular law; consular relations; Vienna Convention on Consular Relations (1963). Consular posts. Consular officers: heads of consular posts; other consular officers. Consular functions. Consular privileges and immunities: privileges and immunities pertaining to the consular post; privileges and immunities of consular officers. Honorary consuls.

Knowledge and understanding

After successfully mastering the course, students will be able to:

- identify sources of international law rules that regulate diplomatic and consular relations among the states and other international law subjects;

- define legal concepts from the area of diplomatic and consular law;

- explain legal institutes in the area of diplomatic and consular law and recognise their connection and integration into the system of international law.

 

Application

After successfully mastering the course, students will be able to:

- group and describe legal institutes from the area of diplomatic and consular relations considering the subjects of international law and specific aspects of international relations;

- apply international law norms that regulate diplomatic and consular relations to concrete examples from international practice;

- illustrate the significance of international law regime of diplomatic and consular relations for the stability of the international order and cooperation among states and other subjects of international law.

 

Analysis

After successfully mastering the course, students will be able to:

- analyse the processes of the emergence of international law norms that regulate diplomatic and consular relations;

- distinguish international law institutes in the area of diplomatic and consular law regarding their functional conditionality, and compare the scope of legal norms considering the specific features of the relations they regulate;

- categorise international law norms that regulate diplomatic and consular relations;

- examine the applicability of international law norms that regulate diplomatic and consular relations on concrete facts in international practice.

 

Synthesis

After successfully mastering the course, students will be able to:

- constrct the connection between individual legal institutes in the subsystem of diplomatic and consular law and their integration in the overall system of international law;

- formulate conclusions about the significance of international law regime of regulating diplomatic and consular relations for the development of relations among the subjects in modern world order.

 

Evaluation

After successfully mastering the course, students will be able to:

- evaluate the significance of international law norms that regulate diplomatic and consular relations for the stability of the world order;

- estimate specific features of diplomatic and consular law as a subsystem within the system of international law;

- evaluate the importance of international law norms that regulate diplomatic and consular relations with regard to the relations of the Republic of Croatia with the states and other subjects of international law;

- assess the efficiency of international law norms that regulate diplomatic and consular relations.

 

Practical and Generic Skills:

After successfully mastering the course, students will be able to analyse international rules that regulate diplomatic and consular relations and evaluate them properly. At the same time, students should be able to apply appropriate legal norms to solve problem situations in the area of diplomatic and consular relations. Acquired competences will enable students to appropriately use relevant international documenta of normative content (treaties, court decisions, resolutions etc.).

Matching Assessments to Learning Outcomes:

Knowledge is tested by an oral exam.

 

Oral examination, which is compulsory for all students, consists of testing the understanbding of legal sources related to diplomatic and consular relations, connectiona nd comparison of rules and institutes is expected, as well as the evaluation of the applicability of international law norms that regulate diplomatic and consular relations considering modern international practice.
