KNOWLEDGE AND UNDERSTANDING
After successfully mastering the seminar, students will be able to:
- Explain the basic concepts such of criminal law and criminal science, their relationship to other branches of law and jurisprudence;
- Critically evaluate and recognize the importance of respecting fundamental principles of criminal legislation and case law (principle of legality, the principle of guilt);
- Understand and explain the fundamental institutions of criminal law dogmatics (actus reus, illegality, mens rea, stages in the commission of a crime, co-perpetration and participation, concurrence, extended criminal offense);
- To define the peculiarities of criminal sanctions and individual criminal offenses;
- Bundle structure of the special part of criminal cegislation to objects of legal protection, identify and understand the most important elements of the crimes (against life and limb, sexual freedom, honor and reputation, property, liberty, official duty, justice, etc.);
- Understand the peculiarities of liability of legal persons for criminal offenses and specificities of international criminal law as part of criminal law in a broader sense.
APPLICATION
After successfully mastering the seminar, students will be able to:
- Interpret the terms of the general part of criminal law and the elements of the offenses in accordance with the relevant methods of interpretation of criminal law norms;
- Demonstrate connections between general and special part of criminal law;
- Apply the knowledge gained from the general and special part of criminal law in practice;
- Interpret the regulations in the field of criminal law in their daily work.
ANALYSIS
After successfully mastering the seminar, students will be able to:
- Check the level and extent of realizing the principle of the rule of law in the area of criminal law and practice;
- Compare the Croatian criminal justice system with criminal justice systems of other countries and to examine its compliance with the basic principles of criminal law of the European Union;
- Identify and allocate dysfunctional norms of criminal law and examine the causes and consequences of the their creation;
- Examine and categorize different theoretical models of criminal law dogmatics and their application in the case law;
- Analyze the existing case law in the field of criminal law;
SYNTHESIS
After successfully mastering the seminar, students will be able to:
- Propose the necessary amendments to criminal legislation and new guidelines in the case-law;
- Prepare the surface for expert analysis of individual institutes of criminal law and criminal offenses;
- Formulate basic features, advantages and disadvantages of the legal and judicial penal policy, and propose solutions to improve these systems;
- Build a methodological system to produce written work in the areas of criminal law;
- Devise a protocol for writing term papers, to formulate appropriate hypotheses and draw up a concept with the model work of literature, to know how to validly argue their claims and make a presentation;
EVALUATION
After successfully mastering the seminar, students will be able to:
- Evaluate the quality, sustainability and feasibility of legal and theoretical institutes of criminal law in practical terms;
- Choose further study of individual segments of criminal law;
- Assess which is the most appropriate area for further sub-specialization;
- To review and evaluate the national criminal justice system in terms of constitutional and international law.
Practical and Generic Skills:
After successfully mastering the seminar, students will be able to:
- Present to the public the learning outcomes;
- Express argument with their own thesis;
- Devise, develop and present their ideas;
- Improve communication skills;
- Prepare a presentation;
- Participate in team work and contribute to its functioning.
Matching Assessments to Learning Outcomes:
1. Debate seminars, organization of mock trials, to connect and check the learning outcomes - knowledge and understanding, application and analysis;
2. Development of written student papers (essays, term papers) and presentation, to check the connectivity of the learning outcomes - synthesis and evaluation
3. Assessment is carried out during the seminar, through the grading of students who participate in the debate and evaluation of seminar papers or presentations. The criteria for evaluation are all learning outcomes - demonstrated knowledge and understanding of the subject matter of criminal law, the ability to apply the regulations to the hypothetical and real cases from the judicial practice, the ability to present their arguments, develop their own ideas through presentations, the ability of the seminar work and presentation, capacity for analysis and synthesis, as well as the proper evaluation of the contents adopted in classes and seminars.
