Description
The first part of the course will introduce students to different forms of indeterminacy of normative documents and the interpretive discretion that results from them. The second part will explore the diversity of law-making operations of legal scholars and judges: resolving antinomies, filling gaps, constructing unexpressed norms, concretizing and weighting principles. In the third part, different types of reasoning in the application of law will be analyzed, especially the argumentation of interpretive decisions. In the fourth part, the interpretation of constitutional documents will be considered. The final part will discuss different descriptive and normative conceptions of interpretation widespread in the doctrine.
