How should the EU regulate business behaviour? Is there a common approach that can apply to all business activities? Are the theories of deterrence and economic rational acting that underpin historical enforcement of private and public law in fact supported by empirical evidence? Should the general regulatory policy be based on sharing information (as in civil aviation and many market surveillance and vigilance systems, such as for medicines and workplace health and safety) and on ethical culture (said to be vital for the financial services sector)? Can regulators and ADR deliver redress more quickly than lawyers and litigation? What are the consequences of all this for redesign of liability and public law systems? What should the relationship be between courts, regulators, ADR and ombudsmen?
