Description:

Introduction to the social security law (terms, philosophy, politics in social security law). Historical development of social security law and social, economic and technological context of its development. Systematisation of public social security systems (according to the benefit types, financing etc.) Development and forms of private and public pension systems in the comparative perspective. Organisation and reform of Croatian pension system. Pension insurance based on generational solidarity versus pension insurance based on funded individual account system. Insured persons, rights and conditions for acquiring benefits within the pension insurance system based on generational solidarity (I. pillar). Insured persons, rights and conditions for acquiring benefits within the pension insurance system based on funded individual accounts (II. and III. pillar). Organisation of Croatian health insurance system. Insured persons, rights and conditions for acquiring benefits within the mandatory health insurance system. Insured persons, rights and conditions for acquiring benefits within the voluntary health insurance system. Organisation of social assistance systems in the comparative perspective. Users and benefits within the Croatian social assistance system. Children allowance. Unemployment insurance in Croatia.

After successfully completing the course, students will be able to:

 

Knowledge and understanding

Define social security law and concept and systems of social security regarding the existing national regulation.

Explain systematisation, divisions and historical development of social security law and the concept and system of social security; the relation between national social security law and international and European standards i.e. domestic, international and European sources of social security law; economic and social significance of social security law in different models through which the concept of social security is realised and in different social security systems. Also explain the significance of social security law in the context of fundamental and constitutional rights and economic and social significance of social security law. Explain systematisation of pšublic social systems, in partiocular health insurance system, pension insurance, unemployment insurance, social welfare, maternity and parental allowances and child allowances.

Recognise applicable law and applicable legal institute for solving certain probnlem from the area of social security law and determine the procedure that has to be applied for the resolution of the problem.

Discuss different models of systems and the development of social security.

Report about problems connected with social security systems and possible adequate solutions for them.

Application

Select applicable law that should be applied to a certain problem.

Interpret applicable law and its characteristics of social security system.

Conduct procedures of determining legally relevant facts and deciding about issues freom the area of social security law.

Apply applicable law.

Use different databases on legal sources, court practice and relevant legal literature in deciding about matters from the area of social security law.

Outline drafts of simpler decisions, normative acts that regulate certain matters from the area of social security law.

Illustrate different possibilities for solving certain less complex issues and different outcomes of these possibilities.

Distinguish between problems connected with social security system, their factual and legal aspects and sources of law relevant for their solution.

Compare different legal and other outcomes of proposals, approaches and possibilities for solving problems.

Indicate proposals, approaches and possibilities optimal for solving problems or connected to social security systems.

Prepare drafts of simpler adequate legal acts and their explanations for solving certain problems related to social security systems.

Propose passing adequate legal acts and explaining them for solving certain problems related to social security systems.

Practical and Generic Skills:

After successfully completing the course, students will understand and be able to explain the concept of social security and its systems. they will be able to explain main characteristics of social security systems. They will be able to determine relevant facts, select a relevant legal framework, analyse court practice and propose an adequate optimal solution to a simpler problem. For that purpose they will be trained to manage and participate in management on lower management and implementation levels in social security systems, state administration and local and regional self-government in connection with social security systems.

Matching Assessments to Learning Outcomes:

Knowledge is assessed through an oral examination.

Oral examination consists of testing the understanding of social security concepts within socieal security law, reproducing theoretical explanations and standpoints of the court, constitutional court and administrative practice of national courts, the European Court of Human Rights and the European Court on individual institutes of social security law and legal instittues characteristic for it, demonstrating the knowledge about public social security systems, especiall health care system, pension insurance, unemployment insurance, social welfare, maternity and parental allowances and child allowances, demonstrating the ability to apply relevant sources of law to resolving individual issues and problems, and the evaluation of individual legal solutions considering their effect on the realisation of fundamental and constitutional human rights and economic and social development.
